Welcome to VietWise ("App", "we", "us", or "our"). By accessing or using the VietWise mobile application, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

VietWise is a mobile application that provides access to Vietnamese wisdom, proverbs, and sayings. The App offers:

• A curated collection of Vietnamese wisdom with English translations
• Audio pronunciations in Vietnamese
• Personalized wisdom feeds based on user preferences
• Journal and note-taking features
• Collection organization tools
• Progress tracking and analytics

2.1 Free Service

The free version of VietWise provides:

• Access to 20 wisdom entries per day
• Basic features including viewing, liking, and saving wisdom
• Limited access to history and analytics

2.2 Premium Service

VietWise Pro is a paid subscription service that provides:

• Unlimited access to all wisdom entries
• Full access to history tracking
• Complete analytics and insights
• Ad-free experience
• Early access to new features

3. Eligibility

You must be at least 13 years old to use VietWise. By using the App, you represent and warrant that you meet this age requirement.

4. Premium Subscriptions

4.1 Subscription Plans

VietWise offers the following subscription plans:

• Monthly Subscription: $14.99 per month
• Yearly Subscription: $39.99 per year

Prices are subject to change. Any price changes will be communicated to you in advance.

4.2 Billing and Payment

• Subscriptions are billed through your Apple App Store or Google Play Store account
• Payment will be charged to your account upon confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

4.3 Cancellation and Refunds

• You may cancel your subscription at any time through your App Store or Google Play Store account settings
• Cancellation will take effect at the end of your current billing period
• Refunds are subject to Apple App Store and Google Play Store policies
• No refunds will be provided for partial subscription periods

5. Content and Intellectual Property

5.1 Public Domain Acknowledgement

The App includes Vietnamese proverbs, cultural sayings, and traditional wisdom that are part of the public domain and Vietnamese cultural heritage. These materials do not belong to any individual or organization, and we do not claim ownership over these public-domain materials.

5.2 Our Intellectual Property

However, we do own the rights to:

• The selection, arrangement, curation, and compilation of wisdom content within the App
• Our original translations and interpretations
• Audio recordings and pronunciations we have created
• Graphics, user interface designs, logos, and branding
• Original written commentary and descriptions
• The software, code, and technical implementation of the App
• The overall presentation and formatting of content

These elements are protected by copyright, trademark, and other intellectual property laws.

5.3 Cultural Acknowledgement

We acknowledge that traditional Vietnamese cultural wisdom is a shared heritage of the Vietnamese community. Our goal is to preserve, present, and celebrate this knowledge respectfully and accurately.

5.4 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes in accordance with these Terms.

6. Prohibited Uses

You agree not to use VietWise to:

• Violate any laws or regulations
• Infringe on the rights of others
• Transmit harmful, offensive, or illegal content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Use automated systems (bots, scrapers) to access the App
• Collect user information without consent
• Use the App for any commercial purpose without our permission

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

While we strive for accuracy in our wisdom translations and pronunciations, we do not guarantee that all content is error-free or complete. The wisdom provided is for educational and inspirational purposes only.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM
• WE ARE NOT LIABLE FOR ANY LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using VietWise, you consent to our collection and use of data as described in the Privacy Policy.

10. Modifications to Terms

We may update these Terms from time to time. When we do:

• We will update the "Last Updated" date at the top
• We will notify you of material changes through the App or via email
• Your continued use of the App after changes constitutes acceptance of the new Terms

11. Governing Law
